Vietnam Tightens Environmental Regulations, Focuses on Extended Producer Responsibility
Vietnam is tightening its environmental regulations, with a focus on Extended Producer Responsibility (EPR). The Ministry of Agriculture and Environment (MAE) has submitted a draft decree to consolidate regulations across 16 laws in agriculture and environment, aiming for implementation in 2026. Meanwhile, the ESG Working Group of the British Chamber of Commerce in Vietnam has proposed alternatives to fines for businesses.
The MAE is drafting an EPR decree to regulate recycling responsibilities for products, packaging, and waste collection and treatment by producers and importers. This comes as the Environmental Protection Law is under review, with EPR being a key discussion point. Jonathan Sourintha, co-vice chair of the Circular Economy Working Group, proposed exempting recycled plastic packaging from EPR obligations to encourage green development.
The MAE is seeking public comments on draft amendments to 16 laws in the areas of agriculture and the environment. Challenges remain, including lack of effective recycling systems for certain packaging types and high recycling costs. The Vietnam Beer, Alcohol, and Beverage Association (VBA) proposed ensuring reasonable EPR costs and providing incentives for dual-role recyclers. Most companies are familiar with EPR regulations and have participated in training sessions organized by the MAE. About 80 per cent opt to contribute to the EPR fund, while 20 per cent combine fund contributions with internal initiatives, and nearly 10 per cent delegate responsibilities to recycling units. Sourintha suggested a mandatory recycling rate with a lower financial fee for recycled plastic packaging, with a ceiling of 2-3 per cent per cycle.
The proposed changes aim to streamline regulations and encourage businesses to take more responsibility for their waste. Public feedback is invited to help shape these important environmental policies. Despite challenges, Vietnam is committed to promoting a circular economy and reducing waste.
